Question by Gregory: What is the legality of “free with purchase” offers?
If I offer (retail) an item as free with purchase, am I obligated to give the item away if someone wants it without a purchase? How can the item be “free”, if it requires a purchase? Thank you!

No. Law varies by State however the real issue is that nothing is truly free since someone had to pay something at sometime to get the item made and delivered.

This marketing tool of offering something for “free” is based on a very old sales tool called “The Puppy Dog” but as you state it more accurately referred to as the “Rope a Dope”.

When someone offers something for free I always ask myself and them ‘How much is it going to cost to get it for free’ and don’t buy until I can answer that question….
